Welcome to OtterHonest. These Terms of Service ("Terms") govern your use of the OtterHonest platform, including our website at otterhonest.com, the business dashboard at app.otterhonest.com, and all related services (collectively, the "Service").

OtterHonest is operated from Denmark within the European Union. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account, submitting a review, or otherwise using OtterHonest, you confirm that you have read, understood, and agree to these Terms. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Account Responsibilities

To use certain features of the Service, you must create an account. When you do, you agree to:

• Provide accurate, current, and complete information during registration.
• Keep your login credentials secure and confidential. You are responsible for all activity under your account.
• Notify us promptly at [email protected] if you suspect unauthorized access to your account.

Business accounts: If you claim or create a business profile, you represent that you are authorized to act on behalf of that business. You are responsible for keeping your business information (name, website, description, logo) accurate and up to date.

3. Review Guidelines

OtterHonest is built on honest, verified feedback. When you submit a review, you agree to the following:

• Be honest. Your review must reflect a genuine experience with the business.
• Email verification. Every review requires email verification before it is published. This is how we keep reviews trustworthy.
• One review per experience. Do not submit multiple reviews for the same interaction or transaction.
• No incentivized reviews. Reviews must not be written in exchange for payment, discounts, or other incentives.

Important: Businesses cannot delete reviews. Reviews that a business believes violate these guidelines can be flagged for our review. We will assess flagged reviews and may remove content that violates these Terms, but the decision rests with OtterHonest, not the business.

Businesses may respond publicly to any review. Responses must be professional and must not contain threats, personal attacks, or misleading information.

4. Prohibited Content

You may not post, upload, or submit content that:

• Contains hate speech, discrimination, or harassment based on race, ethnicity, gender, sexual orientation, religion, disability, or any other protected characteristic.
• Is defamatory, knowingly false, or intended to damage a business or individual's reputation through fabricated claims.
• Constitutes spam, advertising, or promotional material unrelated to a genuine review experience.
• Includes fake reviews, whether positive or negative, written by someone who did not have a real experience with the business.
• Contains personal information about others (phone numbers, home addresses, financial details) without their consent.
• Is illegal, promotes illegal activity, or violates the rights of others.
• Contains malicious code, links to malware, or attempts to exploit the Service.

We reserve the right to remove any content that violates these rules and to suspend or terminate accounts that repeatedly breach them.

5. Intellectual Property

The OtterHonest name, logo, design, and all original content on the platform (excluding user-generated content) are the property of OtterHonest and are protected by applicable intellectual property laws.

When you submit a review or other content to OtterHonest, you retain ownership of your content. However, you grant OtterHonest a non-exclusive, worldwide, royalty-free license to display, distribute, and use your content in connection with the Service. This includes displaying reviews on business profiles, in embeddable widgets, and in aggregated ratings.

You may not copy, reproduce, or redistribute OtterHonest's proprietary content without prior written permission.

6. Data and Privacy

We take your privacy seriously. Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you consent to the collection and processing of data as described therein.

As a platform operating within the EU, we comply with the General Data Protection Regulation (GDPR). You have the right to access, correct, or request deletion of your personal data by contacting us at [email protected].

7. Limitation of Liability

OtterHonest is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, OtterHonest and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes, but is not limited to, damages resulting from reviews posted by third parties, loss of data, or service interruptions.

Our total liability to you for any claim arising from the Service shall not exceed the amount you have paid to OtterHonest in the twelve months preceding the claim, or 100 EUR, whichever is greater.

8. Termination

You may close your account at any time by contacting us. We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion, with or without notice.

Upon termination, your right to use the Service ceases immediately. Reviews you have submitted may remain on the platform as part of the public record unless they violate these Terms.

9. Changes to These Terms

We may revise these Terms at any time by posting the updated version on this page with a new "Last updated" date. For significant changes, we will make reasonable efforts to notify affected users (for example, via email or a notice on the platform).

Your continued use of the Service after changes take effect means you accept the revised Terms. If you do not agree with the changes, you should stop using the Service.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Denmark. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Denmark.

Where applicable, EU consumer protection regulations, including the right to use the European Online Dispute Resolution platform, apply.
